Terms of Use Effective: September 1, 2025

Who we are. “Fox Claims Consultants,” “we,” “us,” or “our” refers to Fox Claims Consultants (the “Company”). These Terms govern your access to and use of our websites, forms, scheduling tools (including Schedule Fox), and communications (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

1) Eligibility & accounts

You must be able to form a binding contract. If you create an account or submit information, you agree to provide accurate, current information and to keep it up to date.

2) Scheduling, estimates, and reports

We provide property-inspection and related services for insurers, adjusters, and property stakeholders. Scheduling confirmations, ETAs, reminders, and delivery of reports/links may be sent by email or SMS if you consent. Any estimate or scope we provide is informational and may be updated based on site conditions, carrier guidelines, or new information.

3) No emergency or life-safety service

Do not use our Services for life-threatening emergencies. Call 911 or local authorities.

4) Acceptable use

  • Do not violate laws or third-party rights;
  • Do not attempt to access non-public areas or interfere with the Services;
  • Do not upload malware or automate scraping without permission.

5) Intellectual property

All content, trademarks, logos, and software are owned by us or our licensors and are protected by law. You may not copy, modify, or distribute our content without permission.

6) Third-party services

We may integrate with platforms such as GoHighLevel/LC Phone (Twilio), Fieldd, Google Workspace, Zapier, and payment processors (if applicable). Their terms and privacy policies apply to their services.

7) Communications consent (SMS & email)

If you opt in, you authorize us to send you SMS and/or email regarding scheduling, status, ETAs, and report links. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Consent isn’t a condition of purchase or service.

8) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT). We do not guarantee continuous, error-free access.

9) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL. Our aggregate liability for claims relating to the Services shall not exceed the greater of $100 or the amount you paid us for the service giving rise to the claim.

10) Indemnification

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

11) Governing law

These Terms are governed by the laws of Sheridan, WY, without regard to conflict of law principles. Venue lies in the state or federal courts located in Sheridan, WY.

12) Changes

We may update these Terms. The “Effective Date” shows when changes take effect. Continued use means you accept the changes.

Privacy Policy Effective: September 1, 2025

This Privacy Policy explains how we collect, use, share, and protect personal information through our websites, forms, Schedule Fox, SMS/email communications, and related Services.

1) Information we collect

  • Identifiers & contact info: name, email, phone number, address, company, role.
  • Service & scheduling data: appointment details, property addresses, access notes, and communications (SMS/email).
  • Technical data: IP address, device/browser info, pages viewed, cookies, analytics.
  • Files & photos: documentation you or our team uploads (e.g., labeled photos, reports).
  • Payment data (if applicable): handled by a processor; we don’t store full payment card numbers.

2) How we collect it

  • Directly from you (forms, bookings, email/SMS, calls).
  • Automatically via cookies, pixels, or analytics.
  • From service providers or your organization (if you’re added as a contact).

3) How we use it

  • Provide and improve scheduling, inspections, reports, and support.
  • Send confirmations, reminders, ETAs, and report links.
  • Security, fraud prevention, and compliance.
  • Analytics and service optimization.
  • Marketing with your consent, where required.

4) Legal bases (for EEA/UK visitors)

Where GDPR applies: consent, contract performance, legitimate interests (e.g., service improvement, communications), and legal obligations.

5) Sharing of information

We may share with service providers/processors that help us operate (e.g., GoHighLevel/LC Phone (Twilio) for messaging, Fieldd for operations, Google Workspace for email/docs, Zapier for integrations, hosting/analytics vendors, and payment processors). We may share with your organization (if we serve you as part of a business relationship) and with authorities when required by law or to protect rights/safety. We do not sell personal information.

6) Cookies & tracking

We use cookies and similar technologies for essential functionality, preferences, analytics, and performance. You can manage cookies in your browser settings. Where legally required, we’ll present a consent banner.

7) Data retention

We keep personal information only as long as needed for the purposes described above, for legitimate business needs, and as required by law. We retain compliance records (e.g., consent logs) for as long as necessary.

8) Security

We implement reasonable administrative, technical, and physical safeguards. No method of transmission or storage is 100% secure.

9) Your choices & rights

  • Opt out of SMS/email: Reply STOP for SMS, or use unsubscribe links in emails.
  • Access/Deletion/Correction: You may request access, correction, deletion, or restriction of your data (subject to legal exceptions).
  • California (CCPA/CPRA): California residents can request disclosure/deletion and opt out of “sharing” for cross-context behavioral advertising where applicable.
  • EEA/UK: You may have rights to access, rectify, erase, restrict, port, or object; you may also complain to a supervisory authority.

10) Children’s privacy

Our Services are not directed to children under 13. We do not knowingly collect personal information from children under 13 (or under 16 where applicable). If you believe a child provided information, contact us to delete it.

11) International transfers

If data is transferred internationally, we use lawful mechanisms (e.g., SCCs) where required.

12) Changes

We may update this Policy. The Effective Date indicates when changes take effect.

SMS Terms (Toll-Free Messaging) Effective: September 1, 2025

Program description. By opting in, you agree to receive SMS from Fox Claims Consultants regarding scheduling, appointment updates, technician ETAs, and report links. Message frequency varies. Msg & data rates may apply. Consent is not a condition of purchase or service.

Opt-in

You may opt in via our website forms (unchecked consent checkbox), booking flows, or written consent collected by your organization.

Disclosure (example for forms):
“By checking this box, you agree to receive SMS updates from Fox Claims Consultants about scheduling and service status. Msg & data rates may apply. Msg freq varies. Reply STOP to opt out, HELP for help. See our Terms and Privacy.”

Opt-out & help

  • STOP: Reply STOP to any message to end. You’ll receive a final confirmation and no further messages unless you opt in again (e.g., reply START).
  • HELP: Reply HELP for support information.

Carriers

Carriers are not liable for delayed or undelivered messages.

Eligibility

You must provide your own mobile number and be the account holder or have authorization.
